AGFS fees to rise from 28 July 2026

The Legal Aid Agency announced that certain fees under the Advocates’ Graduated Fee Scheme (AGFS) will rise from 28 July 2026. The statutory instrument increases the fixed fee for additional preparation from £62 to £81, extends the additional preparation fee to cases concluded by guilty plea, and lowers the minimum number of trial days required to qualify for a wasted preparation claim from five to two. These changes are part of a broader package of AGFS reforms and were introduced early to address the needs of the criminal Bar. The updated rates are available in the amended legislation and Crown Court Fee Guidance. Advocates can claim the new fee via the miscellaneous fees section of the Claim for Crown Court Defence billing tool, with instructions to be issued if the system is not yet updated.
