EBA Launches Consultation on Investment Firm Reclassification Standards

The European Banking Authority (EBA) has initiated a consultation on three draft Regulatory Technical Standards (RTS) regarding the reclassification of investment firms as credit institutions when their total assets exceed the EUR 30 billion threshold. The proposals address methodologies for calculating total assets, reporting requirements, and criteria for granting waivers from credit institution authorisation. These revisions align with 2024 amendments to the Capital Requirements Directive (CRD) and aim to ensure a proportionate and risk-based application of the framework. The consultation period closes on 25 November 2026. The EBA’s draft RTS are based on Article 8a(6)(b) of the CRD, Article 55(5) of the Investment Firms Regulation (IFR), and Article 8a(7) of the CRD. Stakeholders may submit comments via the EBA’s consultation page, with a virtual public hearing scheduled for 30 September 2026.
